Limited Warranty

Limited Warranty Information

Victory Construction ("Contractor") warrants to the original client ("Owner") that the work performed under the contract will be free from defects in materials and workmanship for a period of **two (2) years** from the **Warranty Commencement Date**.
 

**Warranty Commencement Date** The 2-year warranty period begins on the **earlier** of: 1. The date the Owner formally accepts the completed work in writing, or 2. The date of the Owner’s final payment to the Contractor.
 

**What Is Covered** - Repair or replacement (at Contractor’s option) of defective materials or workmanship identified within the 2-year period. - Labor required to correct covered defects.
 

**What Is NOT Covered** 1. Normal wear and tear, misuse, abuse, neglect, or improper maintenance. 2. Damage caused by acts of God, fire, flood, earthquake, or other external forces. 3. Alterations, repairs, or additions performed by anyone other than Contractor. 4. Consequential, incidental, or indirect damages (including but not limited to loss of use, inconvenience, or property damage). 5. Materials or products supplied by Owner or third parties. 6. Cosmetic imperfections that do not affect structural integrity or function. 7. Any work or materials outside the original scope of the contract.
 

**Claim Procedure** 1. Owner must notify Contractor in writing within **30 days** of discovering any alleged defect. 2. Contractor will inspect the claim within a reasonable time. 3. If the defect is covered, Contractor will schedule repairs at a mutually convenient time. 4. Failure to follow this procedure voids the warranty.
 

**Exclusive Remedy** The remedies stated above are the Owner’s **sole and exclusive remedies**. Contractor’s liability is limited to the cost of repairing or replacing the defective work and shall not exceed the original contract price.
 

**No Other Warranties** THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
 

**Transferability** This warranty is non-transferable and applies only to the original Owner.
 

**Governing Law** This warranty shall be governed by the laws of the state in which the work was performed.
